Hyperion Renews Land Options August 31, 2010 31 August 2010

ELK POINT, S.D. – Hyperion Refining has obtained three-year renewals on more than 4,500
acres of land in Union County, including all the core acreage for the Hyperion Energy Center,
Vice President Preston Phillips said Tuesday.
“This is another important step forward for the Energy Center, and demonstrates the
dedication and longstanding support we’ve received from our local partners,” Phillips said. The
project has broad regional support, Phillips noted, but added “A real key to our success has
been the landowners in Union County. They’ve been critical to our progress toward building the
cleanest refinery in the nation and putting 1,800 people to work at good-paying jobs.”
With the core acreage optioned through August of 2013, Phillips said the company is now
focusing on contact with landowners outside the project permit boundaries. Citing the
company’s longstanding position of not commenting on agreements with individual
landowners, Phillips said it’s imprudent to publicly discuss specific tracts or acreages at this
juncture.
Construction on the Energy Center is expected to begin in the second half of 2011, with startup
in 2015. An average of 4,500 jobs will be created over the four-year construction phase, with
the Energy Center bringing more than 1,800 permanent jobs to the Siouxland region.
The Hyperion Energy Center is permitted for a 400,000 barrel-per-day refinery producing ultra
low-sulfur gasoline and diesel and an IGCC (Integrated Gasification Combined Cycle) power
plant. The center will incorporate green principles in its every day functions and integrate only
the most advanced commercially feasible emission control technologies in its operations, as
spelled out in the company’s Green Charter.
