Hyperion Files Re-Zoning Application
December 6, 2007

ELK POINT, S.D. – Hyperion Resources has formally filed its application with Union County officials to change the zoning of property the company has secured near Elk Point. The zone change is necessary if the Hyperion Energy Center, including the cleanest refinery in the United States, is to be built in Union County. The application was filed earlier today.

“With this application we have now begun the public part of the process to potentially site the Hyperion Energy Center in Union County,” said Hyperion Project Executive Preston Phillips. “We look forward to continuing to engage the community as we have been doing for months now throughout the county and sharing the details of our efforts to rezone this property.”

Hyperion will host three community forums in Union County next week. At these open houses Hyperion’s design team and environmental experts will be present to answer questions from the public on the project and share the details of what makes this facility the cleanest in the United States. The open houses begin at 6:00 and end at 10:00 p.m. Residents should feel free to drop by at anytime during those hours to get their questions answered. Forums will be at the Beresford Community Center Dec. 10, Dakota Valley Elementary in North Sioux City Dec. 11, and Elk Point-Jefferson High School in Elk Point Dec. 12.

“Now that we are moving forward with the rezoning it is time to present the details of our plan to the people of Union County,” Phillips said. “These open houses will be an opportunity for residents to get the facts about this facility from experts on the design, permitting, construction and operation of the Hyperion Energy Center.”

The full filing and details on the open houses can be found at the Hyperion Energy Center’s website, at:  http://www.hyperionec.com
