The Hyperion Energy Center wll be subject to both state and federal environmental laws and regulations. The HEC will meet or exceed all regulatory mandates. Before construction can commence, permits and permissions in the following areas shall be obtained:

Air

Construction Stormwater

Industrial Stormwater

Water Discharge

Water Quality Certification

State Water Rights

Local Zoning (obtained for Siouxland Site)

During operations, the HEC will be subject to the Clean Air Act, with respect to air emissions, and the Clean Water Act, with respect to water.
