Summary

Hyperion Refining, LLC (Hyperion) is headquartered in Dallas, Texas. Hyperion Refining is an affiliate of Hyperion Resources, Inc. Hyperion and its affiliates are primarily involved in the domestic and international oil and gas industry. 

Hyperion Refining intends to build the Hyperion Energy Center; a state-of-the-art center consisting of a petroleum refinery and associated electric utility in Union County, South Dakota. Through the development of infrastructure required for heavy industrial activities and a commitment to the highest standards and best practices, Hyperion will establish a center of excellence for this project and other complimentary industrial activities.

The establishment of a Planned Development District, Energy Center Planned Development (ECPD) District, will create an area in Union County, South Dakota where heavy industrial projects whose design and operation are to a level of excellence in terms of efficiencies, productivity, and environmental protection standards and community compatibility. The ECPD District will encompass approximately 3,292 acres and provide an ample transition zone to harmoniously exist within the backdrop of a vast agricultural area. The ECPD District will contain the necessary infrastructure to enable a variety of industrial projects. 

The focus of the ECPD District is a state-of-the-art petroleum refinery and an associated utility plant. The 400,000 barrel per day refinery and associated utility plant will be the first greenfield refinery built in the United States since 1976. The refinery will utilize the latest technology and best practices to produce clean transportation fuels for the Midwest markets. 

All activities within the ECPD District will comply with, meet or exceed all applicable local, state and federal regulatory standards, criteria and requirements. 

Application Status

The Planning Commission held a public hearing on the Application on January 16, 2008. Hyperion provided at least seven days prior notice of the petitioned zoning change and public hearing by the Planning Commission to all landowners of record abutting the Subject Property by registered mail. The County Auditor provided at least ten days prior notice of the proposed zoning change by certified mail to the Clay County Auditor and the Lincoln County Auditor. On January 16, 2008, the Planning Commission made a favorable recommendation of the Application in accordance with the requirements of the Zoning Ordinance. All written testimony submitted to the Planning Commission at the public hearing has been made available to the public, and has been provided to the members of the Board of Commissioners of Union County.

The Board held a public hearing on the Application on March 3, 2008.  Hyperion provided at least seven days prior notice of the petitioned zoning change and public hearing by the Board to all landowners of record abutting the Subject Property by registered mail. With a vote of 5-0, the Board adopted the ordinance on March 11th, 2008. 

Holding true to our promise of letting the people of Union County decide, Hyperion and our supporters gathered twice as many signatures as necessary to put the zone change up for a public vote. On March 25th, the Union County Board of County Commissioners voted to put the issue on the June 3rd primary election ballot.

On June 3rd, 58% of the voters in Union County voted “Yes” for the zone change.
